Natural beauty brand Lotus sues Unilever after leaked advert, court dismisses claim

As India’s fashion beauty industries become more and more organised, the number of legal disputes is mounting and, in the latest case, Lotus Herbals sought action against Hindustan Unilever. However, the Delhi High Court has disposed of Lotus' petition.

Lotus Herbals, a beauty brand that uses natural ingredients, accused Hindustan Unilever, which also produces beauty products, of slandering its product in an advert that was intended for internal use only but was leaked on the messaging app WhatsApp. Lotus Herbals made a petition at the Delhi High Court to state its claim.

The advert in question allegedly claimed that Lotus’ sun cream brand, Safe Sun, was inferior to Unilever’s brand Lakme Sun Expert. Lotus claimed in a court document that the advert made by Unilever sent “a message that the product of the plaintiff is of inferior quality and is not able to protect the skin from the sun rays and hence causing sun burn.”

However, the Delhi High Court disposed of the petition as it concluded that the advert was intended for internal use only and was not intentionally leaked by the business itself. As the lawyers for Unilever argued in a court order dated May 11 that the advert was not made public, the court decreed that the case was closed. Unilever’s lawyers agreed to an undertaking that the company must delete the slanderous part of the advert before making it public.
