Delhi High Court Instructs Amazon India to stop selling Modicare products

The Delhi High Court has issued an interim order to stop Amazon Seller Services from selling Modicare products following a case brought forward by Modicare stating that its products are not for online sale. 

The Delhi High Court gave an interim ruling in favour of Modicare - Modicare- Facebook


Modicare, which produces a number of products including makeup, jewellery, and personal care products, told the Delhi High Court that Amazon India was illegally selling its products online as they are only intended for direct selling. The business, owned by Colorbar founder Samir Modi, filed the case and the judge ruled for an interim order to stop Amazon from selling Modicare products acknowledging that the business is a direct selling company.

“You can sell from customer to customer but you can’t sell them online,” a person familiar with the case told ET Bureau. “Even as per direct selling guidelines, online portals have to seek permission from direct selling companies to sell their products online, which Amazon didn’t have.”

Amazon India replied as reported by ET Bureau: “We cannot comment on sub judice matters. However, Amazon.in is a third-party marketplace which enables sellers to list their products for sale to Indian customers. Sellers on Amazon.in own their respective products and are responsible for product compliances, as may be applicable. As an intermediary under the Information Technology Act, Amazon. in does take appropriate action against sellers who are selling illegal products, as the case may be.”
