Delhi High Court tells Darveys to sell genuine products

​The Delhi High Court has directed Delhi-based fashion e-commerce portal Darveys.com to sell genuine products on its platform and ensure that the products sold by sellers are not fake.


The order of the High Court came after a suit of trademark infringement was filed by French luxury shoe brand Christian Louboutin claiming the website was selling “impaired” or “counterfeit” goods in its name.
 
Justice Prathiba M. Singh directed the e-commerce website Darveys to obtain a certificate from its sellers that the goods are genuine.

“If the sellers are not located in India, prior to uploading a product bearing the Plaintiff’s [Christian Louboutin] marks, it shall notify the plaintiff and obtain concurrence before offering the said products for sale on its platform,” the judge said.
 
Darveys has claimed victory after the verdict and called it a landmark judgement as it has allowed Darveys to sell Christian Louboutin through its portal by providing warranties of all the items sold by them.
 
Darveys landed in trouble within two months of its inception in 2014, as Christian Louboutin filed a lawsuit and managed to get a blanket stay from the High Court, as per which Darveys was ordered to discontinue selling Louboutin on the portal.

Darveys is one of India’s largest platforms for luxury brands and offers up to 60 percent discounts on the products. It claims to have 20,000+ items live on the website from 125+ luxury brands by 800+ authorised boutiques/stores.
