Marco Wagon Retail sends legal notice to Flipkart

Marco Wagon Retail, one of Flipkart’s largest vendors, has sent a legal notice to the Flipkart India for recovery of its dues up to Rs 20 crore (approx $3 million).

Marco Wagon in its legal notice has alleged that Flipkart had asked them to import Skechers shoes from suppliers in China that were pre-designated by e-commerce player, despite Flipkart having an agreement with Skechers South Asia for imports.
 
Marco Wagon further alleged that it was asked by Flipkart to procure the shoes from China, as the dealing would allow it to sell Skechers products at a much higher discount on the online marketplace due to higher margins.

It may be recalled that California-based footwear company Skechers last year had filed a case against Flipkart and its sellers for selling counterfeit Skechers products on its platform.
 
The athletic footwear brand had taken the Indian e-commerce giant Flipkart and its four sellers Retail Net, Tech Connect, Unichem Logistics and Marco Wagon to the Delhi High Court after fake Skechers merchandise was recovered from the warehouses of these sellers post-raids conducted by the authorities.
 
Following that, a blame game began between the sellers and Flipkart with the latter distancing itself from the controversy stating that ‘it only helps sellers connect with customers across the country’.
 
Commenting on the legal notice, a Flipkart spokesperson told Times of India, “All allegations made by Marco Wagon are incorrect. We have already initiated appropriate legal proceedings, including criminal action against Macro Wagon and the matter is subjudice.”
